Wales Brings 2025 Social Care Profit Restriction Changes into Force

According to legislation.gov.uk, the Welsh Ministers made the Health and Social Care (Wales) Act 2025 (Commencement No. 2) Order 2026 on 22 October 2026. Made under section 29(2) of the Health and Social Care (Wales) Act 2025, the Order brings a further set of provisions under that Act into force on 30 October 2026. The instrument was signed by Delyth Jewell, Deputy Minister for Social Care, Mental Health and Women’s Health, acting under the authority of the Cabinet Minister for Health and Care. In policy terms, this is a technical commencement measure rather than a fresh reform package, but commencement orders are the point at which enacted provisions begin to operate in law.

Article 2 commences sub-paragraphs 2(2), (3), (4) and (5) of Schedule 1 to the 2025 Act, together with section 22 of that Act so far as it relates to those sub-paragraphs. The explanatory note states that these provisions make minor and consequential amendments to the Regulation and Inspection of Social Care (Wales) Act 2016. Those amendments relate to provisions in the 2025 Act concerning restrictions on profit in the provision of social care services to children. The Order therefore does not create that policy on 30 October 2026; it activates supporting legal changes needed to make the wider statutory framework work as intended.

That distinction matters because consequential amendments often carry the detailed drafting needed to align one Act with another. Where a later Act changes the policy position for a regulated service, earlier legislation usually needs to be updated so that statutory references, cross-references and related regulatory wording remain consistent. For the Welsh social care system, the immediate effect is mainly one of legal coherence. Once these provisions are in force, the 2016 Act will better reflect the parts of the 2025 Act that deal with profit restrictions in children’s social care, helping the regulatory framework match the primary legislation already passed by the Senedd.

This is the second commencement order made under the 2025 Act. The explanatory material records that the first order, the Health and Social Care (Wales) Act 2025 (Commencement No. 1 and Transitional and Saving Provisions) Order 2025, brought a substantial group of provisions into force on 25 March 2025, the day after Royal Assent. Those earlier commencements included sections 1, 16 and 21, part of section 22, several elements of Schedule 1, sections 23 and 26 in Part 2, and the whole of Part 3. The new Order should therefore be read as the next implementation step in a phased timetable rather than as a standalone change in policy direction.

For providers, commissioners and legal teams, the key date is 30 October 2026. From that point, the specified amendments linked to profit restrictions in children’s social care will have legal effect, and the relevant provisions of the 2025 Act and the 2016 Act will need to be read together. The narrow scope of the Order is also worth noting. It does not introduce a new funding decision, a revised inspection model or a broader restructuring of children’s services. Its purpose is more specific: to switch on identified provisions already enacted, so that the supporting legal machinery for this part of the reform is in place.

The Order is a clear example of how Welsh legislation is often implemented in stages. Primary legislation may establish the policy, but separate commencement instruments are often needed to sequence different provisions, allow for administrative preparation and keep connected statutes aligned. On the face of this instrument, Wales is now moving another part of the 2025 Act from statute to operation. From 30 October 2026, the focus shifts from legislative passage to application, with the supporting amendments for profit-related children’s social care provisions formally in force.
