Wales Teachers’ Pay Order Backdates 2026 Terms to September

The Welsh Ministers have issued the School Teachers’ Pay and Conditions (No. 2) (Wales) Order 2026 to give statutory effect to the 2026/27 pay and conditions framework for school teachers in Wales. The mechanism is indirect but standard: the Order gives legal force to section 2 of the "School Teachers’ Pay and Conditions (Wales) Document 2026 to 2027", which the Welsh Government published on 22 October 2026. (gov.wales) That matters because the operative rules are not set out in the short instrument itself. Employers need to read the Order alongside the published Document and its accompanying statutory guidance, with section 2 containing the binding pay and conditions provisions and section 3 setting out guidance to which local authorities and governing bodies must have regard. (gov.wales)

In policy terms, this is a replacement order rather than a narrow amendment. The earlier School Teachers’ Pay and Conditions (Wales) Order 2026, made in February, gave effect to revised 2025/26 documents and has now been displaced by the new 2026/27 framework. In practical terms, that makes the 2026/27 document the operative reference point for the current school year. (legislation.gov.uk) The Welsh Government had signalled that approach in Anna Brychan’s written statement of 14 October 2026, which said a revised document and a second 2026 order would be made and that the pay award would be backdated to 1 September 2026. (gov.wales)

The legal point with the widest immediate effect is retrospection. The 2026/27 Document states that, once the Order comes into force, its provisions have retrospective effect from 1 September 2026, and section 123(3) of the Education Act 2002 allows that approach provided it is not used to reduce past remuneration or worsen past conditions to a teacher’s detriment. (gov.wales) For teachers, that means the gap between the September pay date and the making of the instrument does not remove entitlement. For payroll teams, that is likely to mean arrears calculations and revised salary notices, and may also require related pension or allowance adjustments where pay is recalculated. (gov.wales)

On pay, the Welsh Government document applies a 3.5% uplift to statutory scale points and allowances, except for the unqualified teacher pay scale, which receives a 5% uplift. The same document also replaces the previous main and upper classroom scales with a single core pay scale, running from C1 at £34,912 to C8 at £53,760 from 1 September 2026. (gov.wales) That structural change is at least as important as the headline percentages. Under paragraph 17, teachers on the new core scale are to receive one point of annual progression after a completed year of qualified service unless capability procedures are under way, moving Wales further towards a more automatic progression model for classroom teachers. (gov.wales)

The non-pay changes are also material. The 2026/27 Document introduces protected leave for school leaders, stating that contact during weekends or school holidays should occur only in exceptional circumstances, and it extends salary sacrifice provisions so that teachers and school leaders may participate in employer-operated vehicle schemes where the tax conditions are met. (gov.wales) Working time has also been adjusted. Full-time teachers remain available for 195 days in the school year, but the balance moves from 190 teaching days and 5 other duty days under the March 2026 framework to 189 teaching days and 6 days for other duties under the new document. The 1,265 directed-hours cap for full-time classroom teachers is unchanged. (gov.wales)

For governing bodies, local authorities and school business teams, the compliance work is immediate rather than theoretical. Relevant bodies must have a pay policy setting out how pay is determined and when annual reviews are completed, salary determinations must take effect annually from 1 September, and each teacher must be notified in writing no later than one month after the determination. (gov.wales) In practice, that points to near-term work on loading the new scales into payroll, calculating back pay to 1 September 2026, checking that leader-contact protocols reflect the protected-leave provision, and reviewing calendars and staffing plans against the new 189-plus-6 day distribution. Employers offering salary sacrifice will also need to decide whether vehicle schemes are operationally available to teaching staff and communicate that position clearly. (gov.wales)

Coverage remains confined to the maintained-school sector in Wales. The document applies to teachers employed by a local authority or by the governing body of a foundation, voluntary aided or foundation special school providing primary or secondary education, and it excludes education provided in establishments maintained by a local authority in the exercise of social services functions. (gov.wales) The broader reading is that this is not simply an autumn pay announcement dressed up as legislation. It is the annual legal instrument that brings Welsh teachers’ pay, working time and selected contractual protections into force for 2026/27, while shifting several operational rules that schools will need to absorb during the current academic year.
